GENERAL TERMS AND CONDITIONS

These General Terms and Conditions govern all rental services for artificial floral arrangements and the associated services provided by MSLH 18 SA under the MyEasyFlower brand, to all its clients, businesses and private individuals alike.

The French version alone is authoritative. The German, Italian and English versions are courtesy translations; in the event of any discrepancy, the French text prevails.

THE ESSENTIALS IN EIGHT POINTS

The summary below is provided to make reading easier. Only the full text of the General Terms and Conditions has contractual value.

1. What you are renting

The floral arrangements remain at all times the property of MyEasyFlower. You are not buying them: you receive a service comprising their provision, upkeep and renewal. The composition evolves from one visit to the next according to the collections available.

2. Monthly rotation and choice of arrangements

Your arrangements are renewed once a month. At each visit, our operative shows you the arrangements available and returns to the vehicle to fetch others if the first selection does not suit you. You are entitled to two presentations included in the service. We never refuse a further choice: from the third presentation onwards, the additional time on site is charged at CHF 70.– per hour, per commenced 30-minute period. You are informed before we proceed.

3. Invoicing and payment

Invoices are sent exclusively by email, in advance for the coming period, and are payable within 7 days. None of our operatives is authorised to accept cash.

4. Term, renewal and termination

Your commitment corresponds to the plan selected (monthly, quarterly, half-yearly or yearly). On expiry, the contract is automatically renewed for a further period of the same length. To end it, your written termination must reach us at the latest 30 days before the end of the current period. After that deadline, the following period is due in full. In the event of early termination, the services already provided are recalculated at the monthly rate without discount, and the difference becomes immediately payable.

5. Care of the arrangements

The arrangements are intended strictly for indoor use: never outdoors, nor on a balcony, terrace or window ledge. Please inform your cleaning staff and your cleaning company not to touch, water or move the arrangements: watering irreversibly destroys an artificial arrangement. In the event of loss, theft or irreversible damage, a lump-sum compensation is due: CHF 380.– for a small arrangement, CHF 520.– for a medium one, CHF 650.– for a large one.

6. Access to your premises

Our visits take place from Monday to Friday, between 08:00 and 17:00. Please notify us of any closure or change of opening hours. Failing that, if our teams travel to your premises and cannot carry out the service, the visit is deemed to have taken place and remains payable; you keep your arrangement until the next rotation, or may request an additional visit, which is charged.

7. Changes to your subscription

Adding arrangements is always welcome and takes effect quickly. Removing an arrangement or a site, by contrast, requires our written agreement, takes effect only at the end of the current period, and may result in the loss of any discount whose conditions are no longer met.

8. Data protection

The processing of your personal data is described in our Privacy Policy, in accordance with the Swiss Federal Act on Data Protection (FADP, SR 235.1) and, where applicable, with the General Data Protection Regulation (GDPR).

Governing law and jurisdiction

These terms are governed by Swiss law. The place of jurisdiction is Crissier, subject to any mandatory places of jurisdiction provided by law.
